AKROS Ltd
TERMS AND CONDITIONS
⚠ Please read these Terms and Conditions carefully before using
our platform. By accessing or using AKROS Ltd services, you confirm that you
have read, understood, and agree to be bound by these Terms.
1.
LEGAL COMPLIANCE
AKROS Ltd is registered and operates under the laws of Saint Lucia. Our
Services are not intended for use in jurisdictions where such services
are prohibited by law or require special local licensing.
If you choose to
access our platform from a restricted location, you do so at your own
risk and are solely responsible for compliance with applicable local
laws. AKROS Ltd accepts no liability for unauthorized access from restricted
regions.
2.
GOVERNING AGREEMENTS
These Terms and Conditions, the MT5 Trading Agreement, and the Customer
Trading Agreement (CTA) shall be governed by and construed in accordance with
the laws of Saint Lucia.
Any dispute,
controversy, or claim arising out of or in connection with these Terms shall be
subject to the exclusive jurisdiction of the competent courts of Saint Lucia,
unless otherwise agreed in writing between the parties.
AKROS Ltd
reserves the right to amend these Terms and the CTA at its sole discretion. The
most current version is always available at www.akrosco.com. Continued use of
our platform www.akrosco.com
following any amendment constitutes acceptance of the revised Terms.
3. ACCOUNT STRUCTURE
Base
Currency: All accounts are denominated in US Dollars (USD) by
default. Deposits or realized profits and losses in other currencies will be
converted to USD at the prevailing internal exchange rate at the time of the
transaction.
Currency
Conversion: Where a conversion is required, AKROS Ltd applies its
internal exchange rate, which may differ from the interbank or mid-market rate.
The applicable spread or fee will be disclosed in the Client Portal prior to
conversion.
Reporting: AKROS
Ltd issues Daily Activity Statements to all active clients. In the event of any
discrepancy between data displayed in the MT5 terminal and the official Daily
Activity Statement, the Statement shall be treated as the final and
authoritative record.
4. MARGIN AND
LIQUIDATION
Client
Responsibility: You are solely responsible for monitoring and
maintaining sufficient margin levels in your account at all times. Should your
account fall below the required margin threshold, you must immediately reduce
your exposure or deposit additional funds.
Real-Time
Monitoring: Margin utilization data is provided in real-time within
the MT5 terminal. It is your responsibility to monitor this data continuously
during open positions.
Stop Out
Level: Compulsory liquidation of open positions will be triggered
when your account equity falls to or below 20% of the required margin (the
"Stop Out Level"). AKROS Ltd reserves the right to adjust this
threshold and will notify clients of any material changes.
⚠ AKROS Ltd is not obligated to
issue a margin call prior to initiating liquidation. You remain liable for any
resulting losses or account deficits.
5.
PLATFORM USAGE & EXECUTION
Account
Security: You are solely responsible for maintaining the
confidentiality of your login credentials. Two-Factor Authentication (2FA) is
mandatory for all desktop access and is managed via the MT5 mobile application.
Any activity conducted through your account is presumed to be authorized by
you.
Price
Quotations: Prices displayed on the platform are aggregated from
multiple third-party liquidity providers. During periods of reduced liquidity —
including market open/close sessions and major news events — spreads may widen
significantly.
AKROS Ltd
reserves the right to suspend price matching during extreme market conditions.
Any such suspension will be applied uniformly and without discrimination.
Hedging: MT5
accounts have hedging enabled by default, permitting simultaneous long and
short positions on the same instrument. Hedged positions still require a margin
component. You must ensure sufficient free margin before initiating a hedge.
Order
Execution and Rejection: Margin sufficiency is validated at the
moment of execution, not at the time a pending order is placed. If your account
has insufficient funds when a pending order is triggered, the order will be
rejected. AKROS Ltd is not liable for losses resulting from such rejections.
Technical
Synchronization: In rare instances of technical latency, platform
display data may fall temporarily out of sync with server-side records. AKROS
Ltd will perform reconciliations to ensure server-side accuracy. The server
record shall prevail in all cases.
Limitation
of Liability: AKROS Ltd provides the platform on an
"As-Is" basis and does not warrant that it will be error-free,
uninterrupted, or compatible with all hardware or software configurations.
AKROS Ltd shall not be liable for losses arising from system outages, hardware
failure, or connectivity issues beyond its reasonable control.
6.
ALGORITHMIC TRADING (EXPERT ADVISORS)
AKROS Ltd permits the use of Expert Advisors (EAs) and custom scripts
within the MT5 platform, subject to the following conditions:

Simulated or back-tested results do not
guarantee future performance and should not be relied upon as indicative of
actual results.
·
AKROS Ltd does not recommend, troubleshoot,
endorse, or assume responsibility for any third-party EA. Disputes regarding EA
performance must be resolved directly with the software developer.
·
AKROS Ltd provides an execution-only service and
does not offer investment advice regarding strategies implemented through EAs.
·
AKROS Ltd reserves the right to suspend or
terminate platform access if automated requests are found to be excessive,
malicious, or disruptive to server stability.
7.
PROHIBITED ACTIVITIES
By using Akros Ltd services, you agree not to engage in the following
restricted activities:
System Integrity
& Security
·
Distributing viruses, Trojans, malware, or any
code designed to disrupt, impair, or interfere with platform functionality.
·
Circumventing, disabling, or bypassing security
features or access restrictions.
·
Reverse-engineering or decompiling any software
underlying the platform.
Fraud & Market
Integrity
·
Engaging in deceptive practices intended to
artificially influence market prices or financial instruments.
·
Attempting to mislead, defraud, or impersonate
AKROS Ltd, its employees, or other users.
·
Using platform content or data to develop a
competing service without prior written authorization.
Financial Crime
(AML & CTF Compliance)
·
Using the platform to facilitate, disguise, or
conduct transactions involving funds derived from illegal activities or
terrorist financing.
·
Conducting transactions with individuals or
entities subject to international economic sanctions.
·
Providing false identity information or
structuring transactions ("smurfing") to evade reporting
requirements.
·
Failing to report suspicious activities as
required by applicable law.
Communication
& Ethical Use
·
Harassing, intimidating, or threatening AKROS
Ltd employees, agents, or other users.
·
Taking actions that disparage or damage the
reputation of AKROS Ltd.
·
Overloading support services with false reports
or engaging in spam communications.
·
Collecting user data or contact information for
unsolicited communications.
Legal &
Regulatory Compliance
·
Using services in any manner that violates
local, national, or international laws.
·
Transferring funds for the purchase of illegal
goods or services.
·
Removing copyright, trademark, or proprietary
notices from any platform content.
⚠ Violations may result in immediate account suspension,
forfeiture of profits, and referral to relevant authorities.
8. DEPOSIT /
WITHDRAWAL
Approved Deposit Channels: Clients must deposit funds exclusively
through the methods listed in the Deposits section of the AKROS Ltd Client
Portal. Services are activated only once funds are cleared and fully credited
to the company's designated accounts.
AKROS Ltd assumes no liability for trading losses or missed opportunities
resulting from delays in the deposit or clearing process. All financial risks
associated with such delays remain with the client.
Third-Party
Payment Restrictions: AKROS Ltd strictly prohibits third-party funding.
Both deposits and withdrawals must originate from and return to accounts held
exclusively in the client's own name. If a third-party transaction is detected,
AKROS Ltd reserves the right to cancel the transfer and return funds to the
original source. The client will bear all associated transaction and
administrative fees.
Withdrawal
Protocols: All withdrawal requests must be submitted via the Secure
Client Portal. You will receive an automated confirmation to your registered
email address. Every withdrawal is subject to mandatory review by our
Accounting Department.

⚠ For digital wallet and
cryptocurrency withdrawals, the client bears full responsibility for the
accuracy of the wallet address provided. AKROS Ltd is only obligated to return
funds to the exact destination entered in the portal. Errors cannot be reversed.
Consistency
of Withdrawal Method: Withdrawals will generally be processed back
to the original deposit source. AKROS Ltd may reject withdrawal requests that
utilize a different payment method from the one used for the original deposit.
Account
Closure and Termination: Clients may request account closure
provided there are no active trades, open investments, or pending regulatory
investigations. If an account is suspended due to a violation of these Terms,
suspected abuse, or fraud, all accrued profits may be forfeited. Refund
requests are reviewed within one (1) business day.
9.
COMPLAINTS AND DISPUTE RESOLUTION
AKROS Ltd is committed to
resolving client complaints promptly and fairly.

Complaints must be submitted in writing via the
Client Portal or to support@akrosco.com.
·
AKROS Ltd will acknowledge receipt of a
complaint within two (2) business days.
·
A substantive response or resolution will be
provided within ten (10) business days of receipt.
·
If you are dissatisfied with the outcome, you
may refer the matter to the relevant regulatory authority in Saint Lucia.
10. EXTERNAL SIGNALS
& ANALYSIS
AKROS Ltd may provide integrated analysis and signals via third-party
providers such as Trading Central. All signals, patterns, and recommendations
generated by these tools are of a general informational nature only and do not
constitute personalized financial advice.
The final decision to execute any trade rests solely with the client. AKROS Ltd
is not liable for losses incurred from reliance on third-party indicators,
signals, or analysis tools.
11. RISK DISCLOSURE
⚠ Trading foreign exchange,
contracts for difference (CFDs), and other leveraged products involves a
significant level of risk and may not be suitable for all investors.
You acknowledge and accept the
following risks:

Leveraged trading can result in losses that
exceed your initial deposit. You may lose all funds held in your account.
·
Past performance is not indicative of future
results. No trading strategy guarantees profit.
·
Market prices can be highly volatile and may
move against your position rapidly and without warning.
·
Platform or connectivity failures may prevent
you from managing open positions in a timely manner.
·
Currency conversion may result in additional
gains or losses depending on exchange rate fluctuations.
·
You should not trade with funds you cannot
afford to lose. AKROS Ltd strongly recommends seeking independent financial
advice before committing capital.
12. INDEMNITY
You agree to indemnify and hold AKROS Ltd, its directors, officers,
employees, and agents harmless against any claims, losses, damages, costs, or
expenses (including reasonable legal fees) arising from:

Your use of or reliance upon the MT5 platform or
any third-party scripts, EAs, or signals.
·
Your breach of any provision of these Terms or
applicable law.
·
Any technical malfunction, market disruption, or
force majeure event beyond AKROS Ltd's direct control.
·
This indemnity does not apply to losses caused
by the gross negligence or willful misconduct of AKROS Ltd.
13. PRIVACY AND DATA
PROTECTION
AKROS Ltd collects, processes, and stores personal data in accordance with
applicable data protection laws and its Privacy Policy, available at
www.akrosco.com/privacy.
By using the platform, you consent to the collection and use of your personal
data for the purposes of account management, regulatory compliance, and service
improvement. AKROS Ltd will not sell or share your personal data with third
parties for marketing purposes without your express consent.
14. DECLARATION AND
ACCEPTANCE
By accessing the platform and using AKROS Ltd services, you certify
that:

You have read, understood, and agree to be bound
by these Terms and Conditions and the Customer Trading Agreement (CTA).
·
You are of legal age in your jurisdiction and
legally entitled to enter into this agreement.
·
You are aware of the risks associated with
electronic trading, including potential system failures, market volatility, and
the possibility of losing your entire investment.
·
You understand that AKROS Ltd may amend these
Terms at any time, with the current version always available at
www.akrosco.com.
·
You are not acting on behalf of a third party
unless you have disclosed this and obtained prior written authorization from
AKROS Ltd.
